3. Client Work & Portfolio Rights
Unless otherwise agreed in writing:
• OrthoBrand retains the right to display completed work in portfolios, marketing materials, social media, and website showcases.
• Client confidential information will not be disclosed.
Clients may request limited confidentiality arrangements in writing prior to project commencement.

4. Scope of Services
Services are provided as outlined in individual proposals, agreements, or contracts.
Any services not expressly included in a written agreement are not included in the project scope and may require additional fees.

5. Payment Terms
• A deposit is required to secure project dates.
• Remaining balances are due prior to final delivery unless otherwise agreed.
• Payments are processed via Dubsado and Stripe.
• Late payments may result in project delays or suspension.
All payments are non-refundable unless otherwise stated in writing.

6. Revisions & Approval
Projects include a specified number of revision rounds as outlined in the agreement.
Additional revisions beyond the agreed scope may incur additional fees.
Final approval of deliverables constitutes acceptance of the work.

7. Photography & Video Services
Usage Rights
Unless otherwise specified:
• Clients receive commercial usage rights for marketing and business purposes.
• Raw files are not provided.
• Editing style and creative direction remain at OrthoBrand’s discretion.
Rescheduling
Rescheduling policies, cancellation terms, and additional session fees will be outlined in individual agreements.

8. No Guarantees
While OrthoBrand provides strategic and creative services, we do not guarantee:
• Specific revenue increases
• Patient acquisition numbers
• Marketing performance outcomes
• Search engine rankings
Results vary based on numerous external factors beyond our control.

9. Limitation of Liability
To the fullest extent permitted by law, AlignHaus Ortho LLC, DBA OrthoBrand shall not be liable for:
• Indirect or consequential damages
• Lost profits
• Business interruption
• Data loss
Total liability shall not exceed the total amount paid by the client for services rendered.

10. Healthcare & Regulatory Compliance
OrthoBrand does not provide medical, legal, or HIPAA compliance advice.
Clients are solely responsible for ensuring their marketing materials comply with healthcare regulations and applicable laws.

11. File Retention
Project files are retained for up to three (3) months following completion. After this period, files may be permanently deleted.
Clients are responsible for securely storing all delivered assets.

12. Termination
We reserve the right to terminate services if:
• Payments are not made
• Communication becomes abusive or inappropriate
• Contract terms are violated
In such cases, fees paid may be non-refundable.

These Terms shall be governed by the laws of the State of Indiana, without regard to conflict of law principles.
Any disputes shall be resolved in the appropriate courts of Indiana.
